Terms of Service

1. Acceptance of Terms

Quikpiq Media (Quikpiq or "we") operates http://www.quikpiq.com (the "site"). Quikpiq.com is a web application that's allows users get their friends' opinions by creating image-based polls. By using quikpiq.com, you (the "User") signify that you have read, understand and agree to be bound by these terms and conditions, whether or not you are a registered user of Quikpiq.com. We reserve the right to change, modify, add or delete portions of these terms at any time without further notice. Any changes to these terms will be indicated at the top of this pages of when the terms was last revised. If you do not agree to these terms, do not use or access this site.

2. Terms of Service

Quikpiq reserves the right to remove any poll for any reason whatsoever. Any poll that includes images that are pornographic, or offensive in nature (including nudity, violence, sexual acts, or sexually provocative images), infringe upon copyrights not held by the uploader, are illegal or violates any laws, will be immediately deleted and the IP address of the user who uploaded the image reported to authorities. Polls that are created with the purpose of violating the law, which includes polls with the subject matters of rape, murder, property damage or theft, will be removed and the IP address of the user who created the poll reported to authorities. Violating these terms will result in termination of your account and your rights to create polls via Quikpiq.com. We reserve the right to ban any individual user or website domain from using our services for any reason.

You understand and agree that this site may include advertisements which are necessary to continue the operations of this site and other Quikpiq products.

You do not hold Quikpiq liable for any damages to your data, images, poll results, polls, comments, votes, messages, graphics, text, tags, or other materials ("Content"). All Content are the sole responsibility of the person from whom such Content Originated. You are responsible for all content that you upload, post via image URL, share, e-mail, transmit or otherwise made available through Quikpiq. Quikpiq does not guarantee the accuracy or integrity of any content on the site, especially its PIQs (votes). By using Quikpiq, you may be exposed to content that is offensive or indecent. Votes, and any results from the votes are the sole responsibility of the voters. Quikpiq is not liable or responsible for any decisions that you have made after seeking votes from the site. We do not suggest using Quikpiq to make life-altering decisions.

You agree to hold Quikpiq, its officers and employees exempt from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of Content you submit, transmit, post or otherwise make available through Quikpiq.

3. Your agreement obligations

You represent that you are of legal age to form a binding contract and are not a person barred from receiving this service under laws from Canada, United States of America or other applicable jurisdiction. To protect children's safety and privacy, children under the age of 13 are not permitted to use Quikpiq.com

4. User account, password and security

User accounts and passwords are created with information from www.Twitter.com ("Twitter") and/or www.Facebook.com ("Facebook"). You are responsible in maintaining the confidentiality of your password and account. You are also responsible for any actions resulting from your account. You agree to notify Twitter or Facebook of any unauthorized use of your account. We are not liable for any loss or damage from accounts created from Twitter or from Facebook.

5. Copyright

By uploading your photos to Quikpiq, or posting via using an image hosted online via its URL, you give Quikpiq permission to use or distribute the photos on Quikpiq.com or affiliated sites. All images uploaded are copyright of their respective owners.

By submitting content to Quikpiq, you grant Quikpiq a worldwide, non-exclusive, royalty-free and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and Quikpiq's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. You understand and agree, that Quikpiq may retain, but not display, distribute, or perform, server copies of your media that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.

Users will not use Quikpiq.com for any purpose or in any manner that infringes the copyrights of any third party, nor will Users upload, email, post, publish, distribute, transmit, submit or otherwise make available through the Quikpiq.com any content that infringes the copyrighted works or violates the intellectual property rights of any third party.

If you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification to Quikpiq's Copyright Agent by e-mail at copyright@quikpiq.com

Quikpiq will terminate the access privileges of any user who repeatedly infringes the copyright rights of others.

6. General Information

The Terms of Service and the relationship between you and Quikpiq shall be governed by the laws of the province of British Columbia, Canada, without regard to its conflict of law provisions. You and Quikpiq agree to submit to the personal and exclusive jurisdiction of the courts located within the province of British Columbia, Canada.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
